  Minimum Wages Act, 1948 (Coal Industry not   scheduled employment )and Payment of Wages Act, 1936,(SECTION 1SUB SECTION 6  "(6) This Act applies to wages payable to an employed person in respect of a wage period if such wages for that wage period do not exceed  twenty four thousand rupees per month or such other higher sum which, on the basis of figures of the Consumer Expenditure Survey published by the National Sample Survey Organisation, the Central Government may, after every five years, by notification in the Official Gazette, specify.".

S.O. 2806(E).—In exercise of the powers conferred by sub-section (6) of section 1 of the Payment of Wages Act, 1936 ( 4 of 1936), the Central Government, on the basis of figures of the Consumer Expenditure Survey published by the National Sample Survey Organization, hereby specifies rupees twenty four thousand per month as the wages under said sub-section (6).

 " The conciliation officer in considering the said representation recorded
that so far as the coal mining workers of organized sector is concerned, they are
getting sufficient wages and other benefits as per the respective 
wage agreements
applicable to them. The conciliation officer, however, observed:- "In the era of
globalization when there is a race for earning more and more profit the
engagement of unorganized workers in mining activity too has become inevitable.
But, this should not be at the cost of sweat and labour of these workers. What
should be the wage for this worker is uncertain. The different employer is giving
different wages in the absence of any fixed guideline/direction in this regard.
Somewhere the workers are not getting wages even for their survival/sustenance.
This department is also helpless to enforce/implement any minimum rats of
wages fixed by the Govt. of India in Scheduled Employment as because the works
relating to coal mining activities neither come within the Schedule of Minimum
Wages Act nor minimum rates of wages have been fixed for the said employment."
